Terms of Service

By creating an account, accessing, or using Soonerism, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, our Privacy Policy, and our Community Guidelines.

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or prominent notice on the site. Your continued use of Soonerism after such changes constitutes acceptance of the modified Terms.

You must be at least 13 years old to use Soonerism. If you are under 18, you represent that you have your parent's or guardian's permission to use the service.

When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password and account
• Not share your account credentials with others
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

You may not create an account using a false identity, impersonate another person, or use a name you don't have the right to use. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

Soonerism allows you to submit predictions, comments, votes, and other content ("User Content"). You retain ownership of your User Content, but you grant us certain rights to use it.

License to Your Content

By posting User Content on Soonerism, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with operating and improving the service.

This license allows us to:

• Display your submissions on the website and in search results
• Create statistics and analytics from aggregated data
• Archive and preserve content for historical purposes
• Share data with researchers (in anonymized/aggregated form)
• Promote the service using examples of community content

Your Responsibilities

You represent and warrant that:

• You own or have the necessary rights to the content you submit
• Your content does not violate any third-party rights (copyright, trademark, privacy, etc.)
• Your content complies with all applicable laws and our Community Guidelines
• Your content is accurate and not intentionally misleading

When using Soonerism, you agree NOT to:

• Violate any laws or regulations
• Infringe on intellectual property rights of others
• Post false, misleading, or defamatory content
• Harass, threaten, or abuse other users
• Create multiple accounts to manipulate voting or content
• Use bots, scrapers, or automated tools without permission
• Attempt to gain unauthorized access to our systems
• Upload viruses, malware, or malicious code
• Spam or send unsolicited communications
• Collect personal information about other users
• Engage in vote manipulation or brigading
• Use the service for commercial purposes without authorization
• Circumvent security features or access controls

Violations may result in account suspension or termination, and we may report illegal activity to law enforcement.

The Soonerism platform, including its design, features, functionality, source code, graphics, and user interface, is owned by Soonerism and protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or create derivative works of our platform
• Reverse engineer or decompile any aspect of the service
• Use our trademarks or branding without permission
• Frame or mirror any part of the service without authorization

User Content remains the property of the users who created it, subject to the license grant described in Section 3.

We respect intellectual property rights and respond to valid copyright infringement notices under the Digital Millennium Copyright Act (DMCA).

If you believe content on Soonerism infringes your copyright, please send a notice to gareth.lapworth@gmail.com containing:

• Your physical or electronic signature
• Identification of the copyrighted work claimed to be infringed
• Identification of the infringing material and its location on our site
• Your contact information (address, phone, email)
• A statement of good faith belief that use is not authorized
• A statement that the information is accurate and you are authorized to act

We will respond to valid DMCA notices by removing or disabling access to the allegedly infringing content. Repeat infringers will have their accounts terminated.

SOONERISM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

• Implied warranties of merchantability and fitness for a particular purpose
• Non-infringement of third-party rights
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free service
• Security or freedom from viruses or harmful components

User Content represents the opinions of individual users, not Soonerism. We do not endorse, verify, or guarantee the accuracy of any User Content. Reliance on User Content is at your own risk.

Predictions tracked on Soonerism are for informational and entertainment purposes only. Do not make financial, legal, or other important decisions based solely on content found on our platform.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOONERISM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

This includes, without limitation, damages for:

• Loss of profits, revenue, or business opportunities
• Loss of data or content
• Harm to reputation
• Service interruptions or errors
• Actions of other users
• Reliance on User Content

Our total liability to you for all claims arising from or related to the service shall not exceed the greater of $100 USD or the amount you paid us (if any) in the 12 months prior to the claim.

Some jurisdictions do not allow limitation of liability for incidental or consequential damages, so these limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Soonerism and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the service
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your violation of any applicable laws or regulations

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, at your expense.

We reserve the right to suspend or terminate your account and access to the service at any time, for any reason, with or without notice. Reasons for termination may include:

• Violation of these Terms or our Community Guidelines
• Illegal or harmful conduct
• Prolonged inactivity
• Request by law enforcement or government authorities
• Unexpected technical or security issues

You may terminate your account at any time by contacting us through our contact form.

Upon termination:

• Your right to access and use the service immediately ceases
• We may delete your account and User Content
• Certain provisions of these Terms will survive (Sections 3, 7, 8, 9, 11)
• Your User Content may remain visible if it has been voted on or commented on by others

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Informal Resolution

Before filing a formal dispute, please contact us at gareth.lapworth@gmail.com to attempt to resolve the issue informally. Most disputes can be resolved this way.

Class Action Waiver

You agree to resolve disputes with us on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Soonerism may contain links to third-party websites, services, or resources. These links are provided for your convenience only.

We do not:

• Control or endorse third-party content
• Guarantee the accuracy of external content
• Accept responsibility for third-party practices
• Warrant the security of external sites

Your interactions with third-party services are solely between you and the third party. We encourage you to review their terms and privacy policies.

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice. We may also impose limits on certain features or restrict access to parts or all of the service.

We will not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

Entire Agreement

These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Soonerism regarding the service.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms at any time without notice.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
